Performance Contracting — Design Team Scenario

Design Team Performance Contracting is applicable to both plans/specifications projects and design/build projects. Design Team Performance Contracting is most successful if it can be implemented very early in the design process, preferably before schematic design. Performance Contracting Consultant:

  1. Develop an energy target for the building, using computer modeling. Provide guidelines and suggestions for energy efficiency measures that will result in a building that meets the targets. Provide the model to the design team so that it can be subsequently used to analyze design alternatives.
  2. Write a specification for the instrumentation needed to measure and verify performance after occupancy. The instrumentation will be provided as part of the building energy management system (EMS) if possible.
  3. Meet with the Owner and the Designer to present the recommendations for a performance contract and to assist in negotiating the terms of the agreement.
  4. Develop a rider to the agreement between the owner and the designer which sets up the terms of the performance contract, including possible bonus fees for meeting or exceeding the target, and/or penalties for failing to meet the target.
  5. Provide additional energy analysis services and advice as the project progresses. The scope of general energy analysis services are limited.
  6. Assist in publicizing the project as a model of energy efficiency and total cost savings.

The Owner will:

  1. Incorporate a rider to the agreement between the owner and the designer which sets up the terms of the performance contract, including possible bonus fees for meeting or exceeding the target, and/or penalties for failing to meet the target.
  2. Install the instrumentation needed to measure and verify energy performance. This instrumentation may be a standard part of the energy management system (EMS).
  3. Monitor energy performance after occupancy, make any necessary adjustments to the target, and determine the amount of the bonus fee to be awarded or penalty to be collected. The Owner may hire a third party to provide this service.

The Designer will:

  1. Provide additional services necessary to design and deliver an energy efficient building. Such services will depend on the type of building delivery system the owner has chosen but are likely to include:

    1. investigate integrated energy efficiency alternatives,
    2. provide estimates of energy performance to the owner with the schematic design, design development, and construction drawing packages, and
    3. play a role in construction administration, and building commissioning.
